The Dorogomilovsky District Court of Moscow fined Igor Yakovlev, head of the Press Service of the Yabloko party, 15,000 roubles on charges of participating in an anti-war action, during which Yakovlev and his wife were at a performance in the theater.
On the evening of 28 February, the police detained Igor Yakovlev and his wife Tatyana Talankina at the Tverskaya metro station in Moscow when they were returning from a performance at the Pushkin Theatre.
The couple was accused of participating in an unpermitted anti-war action that took place that evening in the area, shouting slogans and disobeying police orders. Despite the fact that Yakovlev and his wife had theatre tickets in their hands, the police took the detainees to the Dorogomilovo police station, where they spent half the night.
Protocols of offence were drawn up against Igor and Tatyana under Article 20.2 Part 5 of the Code of Administrative Offenses (“violation by a participant in a public event of the established procedure for holding a rally…”).
On 26 April, Judge of the Dorogomilovsky District Court fined Tatyana Talankina 20,000 roubles, finding her guilty of committing an administrative offense.
The case of Igor Yakovlev was twice returned to the police to eliminate violations in the protocol and was accepted for consideration by the court only in October.
Yakovlev’s lawyer presented in court the couple’s tickets for the performance, confirmation from the theatre of the fact that Yakovlev was at the performance, photographs of the spouses from the theatre lobby with a geotag and time, confirming that they were in the theatre during the action.
The police did not provide the court with anything but the police reports. The Judge rejected the defence lawyer’s request to demand a video of the detention from the police.
Tatyana Talankina has already appealed her fine. The court hearings on her complaint will be held in the Moscow City Court on 25 November. Igor Yakovlev will challenge the decision of the Dorogomilovsky City Court as soon as he receives the written decision of the court.
