The Constitutional Court of the Russian Federation adopted the case initiated by Yabloko municipal deputies in St. Petersburg
Press Release, 2.08.2021
The Constitutional Court of the Russian Federation accepted the case initiated by lawyer Alexander Kobrinsky in defence of the interests of the Yabloko deputies from the St. Petersburg municipality of Liteiny Okrug.
In 2019, 11 out of 20 mandates in the council of this municipality were taken by representatives of Yabloko, but it turned out that four days before the elections, a provision was made to the charter of the municipality stating that the head of the municipality is elected by a qualified, rather than a simple majority of votes of deputies. As a result, the duties of the head have remained with a pro-government United Russia deputy, elected by the previous convocation.
When challenging this provision of the charter, Alexander Kobrinsky represented the interests of the deputies in the courts of all levels, but received refusals in all the instances. However, now the Constitutional Court will answer the question whether it is possible in such a way to block the expression of the will of voters expressed in municipal elections.
The Constitutional Court will consider this claim without holding hearings.
