Mustafa Dzhemilev officially prohibited to enter Russia
Leader of the Crimean Tatars Mustatfa Dzhemilev is not allowed to enter Russia for five years term. The decision was taken by Federal Security Service representative in accordance with Subparagraph 1 Part 1 Article 27 of the Federal Law No 114 which states “a foreign citizen or a stateless person shall be refused a permission to enter in the Russian Federation if this is necessary for the purpose of ensuring the defensive capability or security of the state or public order or protecting the health of the general public”.
The information is contained in the letters from Chief Military Prosecutor’s Office and the Prosecutor’s Office of the Crimea in respond to Sergei Mitrokhin’s appeals.
In May 2014 YABLOKO leader forwarded an appeal to Public Prosecutor General Yuri Chaika demanding to protect the right of Mustafa Dzemilov, leader of the Crimean Tatars, to enter the territory of Crimea.
First, Dzhemilev was withdrawn from a flight from Moscow to Simferopol, and the following day he was not allowed though a checkpoint in Armyansk. However, Article 11 of the Law “On the Legal Status of Foreign Citizens in the Russian Federation” stipulates that foreign citizens have the right to the freedom of movement for personal or business purposes within the Russian Federation.
Mitrokhin also demanded to stop persecution of representatives of the Crimean Tatars, who had gobe to greet Dzemilev in the checkpoint in Armyansk.
Prosecutors refused to conduct a check of legacy of the actions of the Federal Security Service.
“And the court won’t do it. According to the present policy of court, such decisions of
FSB aren’t checked by court,” commented adviser of YABLOKO Chairman Vitaly Reznikov.
The legacy of FSB’s immunity from court review was concerned by all judicial instances.
The Constitutional court also refused to have such an immunity.
“Dzhemilev will be allow to enter Russia either after a political decision or after interfirance of European Court for Human Rights. Counting on justice in the Russian courts is useless”, said YABLOKO leader Sergei Mitrokhin.
