Today, on June 7, YABLOKO’s leader Sergei Mitrokhin submitted
an application to the Moscow City Court disputing lawfulness
of the General Plan of Moscow Development. Mitrokhin asks
the court to recognise adoption of the General Plan of Moscow
Development null and void.
Mitrokhin indicates the following violations: the Plan was
not coordinated with the Russian Government and the Government
of the Moscow Region and failed to obtain a positive conclusion
by the state expertise. Also the Plan lacked a package of
required documents, in particular protocols of public hearings.
“The conclusion of the state expertise was signed on December
22, 2009, a month after the draft General Plan of Moscow Development
was submitted to the Moscow City Duma. This fact alone will
suffice for abrogation, however, in our statement we indicate
a number of other procedural violations,” Sergei Mitrokhin
said.
We already have a positive precedent from St.Petersburg where
they tried to adopt the same kind of plan. However, the Moscow
Plan lacks a very important document – an approval by the
Russian Government. This fact alone will play in the hands
of the Muscovites dissatisfied with the Plan. “I don’t think
that the bureaucrats will dare to fraud with such a document,”
Mitrokhin said.
