Dissenting Opinion
To the protocol of the Moscow Electoral Commission
on the results of the voting for the candidates to deputies of the Moscow City Duma of the 5th convocation
in the Moscow electoral district
on October 11, 2009


We are expressing our dissenting opinion with the results of the election to the Moscow City Duma in the Moscow electoral district. Multiple violations detected during voting and calculation of the votes make it impossible to assess the results of the election.

The following violations were detected during voting:
- multiple cases of groundless disqualification of members of electoral commissions and groundless exemption of observers representing oppositional parties from the polling stations;
- infringement of candidates’ rights, in particular, ousting them from the polling stations and not letting them to observe calculation of the votes;
- faking of voters’ signatures and unlawful distribution of bulletins;
- “throwing-in” of bulletins, voting by persons not included into the voters lists;
- refusal of electoral commissions to deal with complaints (for example, electoral commissions from polling stations ¹¹ 40, 123, 127, 291, 487,762, 869, 1306, 1533, 1701, 1919, 1928, 2005);
- protocols submitted by local electoral commissions to the territorial electoral commissions diverged from the signed copies of protocols given to observers (for example, local electoral commissions ¹¹ 150, 187, 200, 207, 291, 323, 324, 423, 436, 689, 714, 732, 1083, 1162, 1186, 1201, 1323, 399, 1532, 1522, 887, 888, 399, 401, 404, 1528, 1701, 762, 127, 2000, 1957, 1192, 869, 1927, 1715, 120, 1213, 1791);
- mass-scale refusals by chairs of local electoral commissions to give lawful demand of the observers the copies of final protocols right after calculation;
- handing to the observers copies of protocols drawn with violation of the law (for example, without indication of the date and time of signing of the copy, or the person signing the copy, or giving unsigned copies to the observers);
- violation of the procedure of drawing of final protocols of the voting, drawing of protocols with violation of the present laws.

The indicated violations can result in annulment of the results of the voting, as such violations do not allow to accurately determine the results of expression of the voters’ will.

We assume, that the procedure of drawing up of the results of the voting in the Moscow electoral district can not be considered finished, as a range of complaints of violation of the election law, both during voting and calculation of the votes, received by the Moscow Electoral Commission was not examined by the said commission.

In addition we would like to draw attention to the following:

– multiple violations of the principle of equality of rights of the candidates and electoral blocs during campaigning at television and radio channels and printed media;
– violation of the rights of election blocs regarding their free choice of the forms and methods of campaigning;
– creation of obstacles in campaigning for the CPRF and the YABLOKO party;
– abuse of candidates from the United Russia party of their posts.
